How Does Military Divorce Work in Ohio?

In order to file for military divorce in Ohio, you must meet certain requirements. Firstly, either you or your spouse must reside in or be stationed in Ohio. Secondly, you must have grounds for divorce (same as civilian divorce).

Under the Soldiers and Sailors Civil Relief Act:

  • Divorce proceedings can be postponed for the entire period of active duty;
  • Divorce proceedings can be postponed for up to 60 days after active duty has concluded;
  • And, the right to postpone divorce proceedings can be waived by the active military member

Additionally, the active duty military member spouse must be served with both a copy of the divorce action and summons in person. This allows the Ohio court to retain jurisdiction over the military service member. An exception to this rule is in the event of an uncontested divorce. If a military divorce is uncontested, the active duty member may sign a waiver affidavit acknowledging the divorce.

Division of Property, Child Support & Spousal Support in Military Divorces

The Uniformed Services Former Spouses’ Protection Act (USFSPA) states that military retirement benefits will not be divided with the former spouse unless the marriage lasted at least 10 years while the military service member was on active duty.

Additionally, child support and spousal support cannot exceed 60% of a military service member’s income by law. This is typically the only deviation from Ohio’s child support guidelines used to determine how much child support must be paid to the custodial spouse.
