How Is Child Support Determined in Ohio?

Generally speaking, in the state of Ohio, both parents have a presumed duty to provide for and support their child until he or she reaches the age of 18. Certain circumstances, such as a child with a mental or physical disability requiring ongoing care and/or treatment, whether or not the child is still in high school at the age of 18, a legally emancipated child, or a pre-arranged agreement between the parents may alter the length of time that child support must be paid.

In most cases, the non-custodial (or non-residential) parent is responsible for making child support payments. The amount of child support that must be paid is determined by the court based on the Ohio child support guidelines, as established by the Ohio Supreme Court. These guidelines use various factors, such as the gross income, the number of children, type of custody, etc. to determine the dollar amount that must be paid to the custodial parent.

Deviations from the Ohio Child Support Guidelines

If the other parent of your child has challenged court-ordered child support payments or you believe that you were ordered to pay an unfair amount, you may be wondering whether exceptions can be made. In fact, certain circumstances may lead the court to deviate from the Ohio child support guidelines.

When deciding if child support payments are appropriate and fair, the court will look at a number of factors, including but not limited to:

  • Income disparity between the two households
  • Whether or not the child has special needs
  • Whether other court-ordered payments are in effect
  • If either parent is responsible for supporting other individuals
  • The physical, emotional, and educational needs of the child
  • Any extraordinary obligations for other children
  • If there are extraordinary costs associated with parenting time
  • Any relevant benefits a parent receives through another spouse/partner
  • The standard of living for both parents and the child
  • Any additional employment obtained by the paying parent to support another family

Additionally, child support payments can be modified after the original court order. To petition for a child support modification, it must be at least 36 months past the original court-issued order (or previous modification). It’s possible to request an administrative review if the original child support order doesn’t take into account health insurance for the child or if there has been a drastic, specific change in circumstances.
