What Can (and Can’t) Be Covered by a Postnuptial Agreement?

Under the Uniform Marital Property Act (UMPA), spouses may enter a postnuptial agreement that alters how their property is characterized by state law. In order to be valid, a postnuptial agreement must be signed by both spouses.

UMPA outlines a number of issues that can be covered by a postnuptial agreement, including but not limited to:

  • Who can manage, control, or have rights to any given property
  • How property will be divided in the event of divorce, separation, dissolution, etc.
  • The disposition of property in the event of death
  • Matters related to spousal support, including elimination or modification thereof

A postnuptial agreement cannot make changes to child support when the two parties have a child together. Additionally, postnuptial agreements can be modified or changed at any time and are not considered valid if one spouse was pressured or threatened by the other spouse to enter the agreement.
